The Hungarian Constitution of 2012 and its Protection of Fundamental Rights (2012:3epa)

The new Hungarian Constitution – that entered into force in January 2012 – has faced widespread international criticism. This analysis intends to explain why that is the case and views the debate from a legal and constitutional perspective. The author also discusses the possible impact of the legal measures that already have been or may be brought by the EU against Hungary.

Freedom of the press in Europe and the EU – the Hungarian media law in a legal context (2011:2epa)

At the end of last year, the Hungarian parliament adopted a new media law. It was met by strong reactions and believed – among other things - to constitute a threat to the freedom of the press and being incompatible with EU law. Even the European Commission questioned the law, leading up to the remodeled version approved by the parliament in the beginning of March. The European Parliament, among others, has however stated that it will carefully follow the implementation of the law.

The Lisbon Treaty and the balance of power between EU institutions (2008:7epa)

This analysis describes how the relations of power between the EU institutions are affected by the Lisbon Treaty.

It seems that there will be a slight weakening of the Minister Council, on behalf of the European Council, while the Commission's role changes less than what the Convention first proposed in its draft for a new constitution. The Parliament's influence increases by the Treaty on several different areas, especially in changes in treaties, within legislation and budgeting.

A Constitution for Europe? Reflections

In this collected volume five authors have been asked to give their views on the Constitutional Treaty and the aspects of it that they find most interesting. The result is a collection of studies on balance of powers and democracy in the EU.
